For Advisors and Attorneys: Helping Clients Get Truly Organized

You drafted a flawless plan. Eighteen months later the family is still calling to ask where things are. That gap is not a legal problem.

Every estate professional knows the call. A client has died, the documents are in order, and the family is nonetheless lost: they cannot open the email, they do not know which institutions hold accounts, they are arguing about a funeral nobody discussed. The plan was valid. It was not usable.

The Gap, Precisely

Legal instruments answer who decides and who receives. Families in week one need answers to where is it, how do we get in, and what did they want. Those live outside the documents, usually in the deceased's head, which is the one place nobody can reach.

The results are measurable: roughly 20 months to settle, about $12,500 in out-of-pocket cost, 67% of families unable to find essential documents, and 44% ending in conflict. Very few of those cases involve a defective will.

What to Add to Your Engagement

  • An account inventory. Institutions and purposes, not balances or passwords. This single artifact removes the largest block of family time.
  • Access instructions. Legacy contacts on major platforms, a password manager with emergency access, phone and computer codes stored safely. Note that logging into a decedent's account can violate platform terms, which is exactly why legacy contacts matter.
  • A beneficiary audit. Retirement and insurance designations override the will you just drafted. Stale forms quietly undo good planning.
  • Non-legal wishes. Funeral preferences, sentimental items with reasoning, pets. The reasoning is the conflict prevention.
  • A named knower. One person told, out loud, that the plan exists and where. Without this step, everything above scores zero.
  • A review cadence. Annual or life-event triggered. A five-year-old inventory is a rumor.

Why This Is Good Practice Economics

Organized clients settle faster, generate fewer unbillable emergency hours, and produce families who experienced you as the reason things went smoothly. That is the strongest possible referral, and it is also how firms retain the next generation instead of losing the relationship at the moment of transfer.

Positioning matters too: “I make sure your family can actually use this” is a differentiator no competitor is claiming, and it reframes organization as care rather than admin.
